Article 3 – Applicability

  1. These Terms and Conditions apply to every offer made through our online store and to every agreement concluded between The Coffee District and a consumer.

  2. A consumer is a natural person who makes a purchase for purposes outside their trade, business, craft or profession.

  3. These Terms and Conditions are made available before an order is placed and can be saved or printed.

  4. If a provision of these Terms and Conditions conflicts with mandatory consumer law, the mandatory legal provision will apply.

Article 4 – Products and Offers

  1. We describe our products as accurately as reasonably possible. Product images are illustrative. Colours and appearance may vary slightly because of screen settings, natural materials or production differences.

  2. Obvious typographical, pricing or other errors do not bind us. If an error affects an order, we will contact the customer and offer the choice of confirming the order at the correct price or cancelling it for a full refund.

  3. Offers are valid for the period stated and while stocks last.

  4. The main product characteristics, total price including VAT, delivery charges and available payment and delivery methods are shown before the order is placed.

Article 5 – Orders and Payment

  1. An agreement is concluded when the customer places an order and we send an electronic order confirmation, subject to product availability and successful payment.

  2. Before placing the order, the customer can review and correct the order details.

  3. Payment is made using one of the payment methods offered at checkout.

  4. If a product is unavailable after an order has been placed, we will notify the customer promptly and refund any amount paid for that product. We will not send a substitute without the customer’s agreement.

  5. We may refuse or cancel an order where permitted by law, for example in the event of suspected fraud, an obvious error or unavailability. If payment has already been made, we will refund it promptly.

Article 6 – Prices

  1. All consumer prices are stated in euros and include VAT unless clearly stated otherwise.

  2. Delivery charges and any other mandatory additional costs are displayed before the customer places the order.

  3. Price changes do not affect orders that have already been confirmed, except where the displayed price was an obvious error.

Article 7 – Delivery and Collection

  1. We deliver to the address supplied by the customer. The customer is responsible for checking that the address is complete and correct.

  2. The available delivery and collection options, estimated delivery times and charges are displayed on our website or during checkout.

  3. Unless a different delivery period has been agreed, we will deliver without undue delay and no later than 30 days after the agreement is concluded.

  4. If we cannot deliver within the agreed period, the customer may give us an appropriate additional period for delivery. If we still fail to deliver within that period, the customer may cancel the agreement and will receive a refund. An additional period is not required where delivery by the agreed date was essential or where we have refused to deliver.

  5. The risk of loss of or damage to a product passes to the customer when the customer, or a third party appointed by the customer other than the carrier, receives the product.

  6. For store collection, the order confirmation will state when and where the order can be collected.

Article 8 – Right of Withdrawal

  1. For most products purchased online, the customer has the statutory right to cancel the agreement without giving a reason within 14 days.

  2. The withdrawal period expires 14 days after the day on which the customer, or a third party appointed by the customer other than the carrier, receives the product. For an order containing several products delivered separately, the period starts after receipt of the final product.

  3. To exercise the right of withdrawal, the customer must inform us of the decision before the withdrawal period expires. The customer may email us at info@coffeedistrict.nl;
  4. A clear statement containing the customer’s name, order number and the products being returned is sufficient. Use of the model form is optional.
  5. After notifying us of the withdrawal, the customer must return the products within 14 days to the return address stated in Article 2.

  6. The customer may inspect a product as they would reasonably be allowed to do in a physical shop. The customer is responsible only for any reduction in value caused by handling beyond what is necessary to establish the product’s nature, characteristics and functioning.

  7. Original packaging is preferred where reasonably possible because it helps protect the product, but it is not a condition for exercising the statutory right of withdrawal.

Article 9 – Exceptions to the Right of Withdrawal

The right of withdrawal does not apply where a statutory exception applies. This may include:

  • products made to the customer’s specifications or clearly personalised;

  • products that are liable to deteriorate or expire rapidly;

  • sealed products that are not suitable for return for reasons of health protection or hygiene if the seal has been broken after delivery; and

  • other products or agreements excluded by applicable law.

Where an exception applies to a particular product, we will clearly inform the customer before the order is placed. The sale of food or coffee is not treated as automatically excluded in every case.

Article 10 – Return Costs and Refunds

  1. Unless we state that returns are free, the direct cost of returning a product after withdrawal is paid by the customer. This does not apply when the product is defective, damaged, incorrectly delivered or otherwise does not conform to the agreement; in those cases, we bear the necessary return costs.

  2. Following withdrawal from the entire order, we will refund all payments received for that order, including the cost of our least expensive standard delivery option. Any additional amount paid for a more expensive delivery option chosen by the customer will not be refunded.

  3. If only part of an order is returned, the original delivery charge will not be refunded unless the remaining order would have qualified for a lower delivery charge and the law requires an adjustment.

  4. We will issue the refund without undue delay and no later than 14 days after receiving the withdrawal notice. We may withhold the refund until we have received the returned products or the customer has supplied evidence of having sent them back, whichever occurs first.

  5. Refunds are made using the same payment method used for the original transaction, unless the customer expressly agrees otherwise. No refund fee will be charged.

Article 11 – Statutory Conformity and Guarantee

  1. Products must conform to the agreement and have the qualities a customer may reasonably expect, taking account of the product description and other information provided before purchase.

  2. Statutory consumer rights apply in addition to any manufacturer’s or commercial guarantee. A commercial guarantee does not restrict those statutory rights.

  3. If a product is defective, damaged, incorrectly delivered or otherwise does not conform to the agreement, please contact us at info@coffeedistrict.nl and include the order number and a clear description of the issue. Photographs may help us assess the problem but are not required where they are not reasonably available.

  4. The customer must notify us within a reasonable period after discovering the issue. Under Dutch consumer law, notification within two months of discovery is considered timely.

  5. Where the customer has a valid statutory claim, the available remedy may include repair or replacement free of charge. If repair or replacement is impossible, disproportionate, refused or not completed within a reasonable time and without significant inconvenience, the customer may be entitled to an appropriate price reduction or cancellation and refund, in accordance with applicable law.

  6. Normal wear and tear, damage caused by misuse, improper storage or failure to follow reasonable product instructions is not a lack of conformity for which we are responsible.

Article 12 – Complaints

  1. Complaints can be submitted to info@coffeedistrict.nl. Please include the order number and a clear description of the complaint.

  2. We will acknowledge and respond to complaints within 14 days of receipt. If more time is reasonably required, we will confirm receipt within that period and indicate when a fuller response can be expected.

  3. Submitting a complaint does not limit any statutory rights or remedies available to the customer.

Article 13 – Liability

  1. Nothing in these Terms and Conditions excludes or limits liability where exclusion or limitation is not permitted by law.

  2. We are not liable for damage caused by the customer’s improper use or storage of a product, or by failure to follow reasonable instructions supplied with the product.

  3. A limitation of liability in these Terms and Conditions does not affect the customer’s statutory rights relating to defective products, product safety, death or personal injury caused by negligence, fraud or any other liability that cannot lawfully be excluded.

Article 14 – Personal Data

We process personal data in accordance with our Privacy Policy, available separately on our website.

Article 15 – Governing Law and Disputes

  1. These Terms and Conditions and agreements concluded through our online store are governed by Dutch law.

  2. This choice of law does not deprive a consumer who lives in another country of any mandatory consumer protection provided by the law that would otherwise apply to them.

  3. We encourage customers to contact us first so that we can try to resolve any dispute directly.

  4. If a dispute cannot be resolved, it may be submitted to the competent court or to another competent dispute-resolution body where applicable.

  5. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Article 16 – Changes to These Terms and Conditions

  1. We may update these Terms and Conditions from time to time. The version in force when an order is placed applies to that order.

  2. Changes will not reduce rights already acquired under an existing agreement.
